ROS Technology Services, Inc., doing business as Rosnet (also referred to in this Privacy Notice as "Rosnet," "we," "our," and "us") is committed to safeguarding your privacy in our various interactions with you including your use of our website located at https://www.rosnet.com. We use this Privacy Notice to clearly disclose to you our privacy practices for website data. This Privacy Notice does not apply to use of our PowerCenter and StaffLinQ mobile or desktop applications, which are governed by a separate privacy notice available within those apps. If there is something you do not understand about our privacy practices, please feel free to contact us using the contact information listed at the end of this Privacy Notice.

We may change this Privacy Notice from time to time so please check back often. If we significantly change our collection, use, or disclosure practices, we may send you an updated notice via email if you have provided us with an email address. Please keep in mind that some of the services mentioned specifically in this Privacy Notice may not be available on the website at this time. If you are applying for a job with Rosnet or are completing our employee on-boarding processes with Rosnet, your use of the website for those purposes is governed by our HR Privacy Policy.

Scope of this Privacy Notice

Different categories of information are collected and processed differently based on the relationship we have with you. The relationship we have with our clients—restaurant businesses—is different than the relationship we have with website visitors, or the relationship we have with restaurant employees.

If you are an employee, customer, vendor or other person who provides your personal information to one of Rosnet's restaurant clients for back-of the-house restaurant software and services (a "Rosnet Client"), Rosnet is acting as a "processor" or "service provider" under applicable privacy laws and your personal information is subject to the privacy notice or privacy policy of the Rosnet Client who is acting as the "controller" or "business" under applicable privacy laws. When acting as a processor or service provider, Rosnet protects your personal information under a Data Protection Addendum the applicable Rosnet Client and you may make a request under your privacy rights through the applicable Rosnet Client. We will assist them in complying with your request.

If you are a website visitor, Rosnet acts as a controller when you visit our public-facing website https://www.rosnet.com, even if you are a Rosnet Client or an employee of a Rosnet Client. However, the website may contain links to other websites, applications, and services from third parties (like LinkedIn or Facebook, for example). The privacy and data security practices of those third-party sites are governed by the privacy policies of those third parties, and not by Rosnet.

If you are a Rosnet client operating a restaurant or an employee of a Rosnet Client using our PowerCenter or StaffLinQ applications, then your use of those applications is governed by our application privacy notice and the privacy notice or privacy policy of the applicable Rosnet Client, and not this website Privacy Notice.

If you are a restaurant customer that made a purchase from one of our restaurant clients, you might not be aware that the restaurant you directly interacted with used Rosnet services during your transaction with the restaurant. After you place your order with the restaurant, the restaurant may have used our services to process information related to your order including (in some cases) sharing the last four digits of your card number with us. If so, the restaurant is the controller of your information, and we came into play as the processor of that information when the restaurant directed us to process your data on its behalf.

What information do we collect from you?

We collect information in several ways. Some of the information we collect is personal to you. Other information is anonymous. Our website collects the following categories of information:

• When you report a problem with our website or services we will collect contact information along with a description of your problem;
• When you use the contact us or schedule a demo feature on our website, we collect the information you provide, including your name, email address, company name, number of locations, your product interests, and any information you include in your message to us;
• When you leave a public comment on our blog, we collect the information you provide including your name, email address, website, and the content of your post;
• When you contact us via the company email address, we will collect your contact information and any information you include in your email;
• To customize our service for you, the applicable Rosnet Client may require us to collect precise location data, including the real-time geographic location of your computer or device. This location data is collected anonymously in a form that does not personally identify you;
• When you visit and navigate our site, use third party sites, or open our emails, we may collect technical information about your use of our site including IP address, device identifier, and viewing information.

Our website is not intended to solicit, collect or process personal information from any individual under the age of 16. If you are a parent or guardian, please contact us if you believe information regarding a child has been collected by us through our website.

How do we collect information from you and how can you opt-out of information collection?

Direct Collection

We collect much of the information listed above directly from you when you submit it to us through email, on our website, or in other interactions you have with us. Web Beacons. We also employ software technology called a clear GIF (Graphics Interchange Format), also known as a pixel tag or Web beacon. A clear GIF is a line of code that we place on our websites or in e-mails which allows us to analyze our advertising and the general usage patterns of visitors to our websites. These help us better manage content on our site by informing us what content or promotions are effective.

Log Files. Like most standard website servers, we use log files. Log files track Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks. We utilize this information to analyze trends, administer the site, prevent fraud, track website navigation in the aggregate, and gather broad demographic information for aggregate use.

Indirect Collection – Social Networking

The website permits you to use a third-party social networking platform such as Facebook, X, and LinkedIn. This includes use of social media plugins such as Facebook “Like” buttons, etc. When you use these social networking platforms and plugins, your username and password for the available service or collected from you on these services may be shared with us. When you use social networking platforms and plugins, you share your information with them and their privacy notice applies disclosure of such information. In addition, they may be able to collect information about you, including your activity or may notify your connections on the social networking platform about your use of the Rosnet website. Such services may allow your activity to be monitored across multiple websites for purposes of delivering more targeted advertising. Please note that their own privacy polices apply and we encourage you to read them. We may add new social networking plugins and buttons to our websites from time to time.

Indirect Collection – Targeted Advertising

We also use cookies, web beacons, pixel tags, and similar tracking technology to serve and enable targeted advertising, interest-based advertising, and cross-context behavioral advertising (generally referred to as “Targeted Ads” and “Targeted Advertising”). We may use your personal information to facilitate the delivery of Targeted Ads.

How do we use your information?

Our main goal in collecting information is to improve the site and provide you with the best possible experience on the website. For example, by using the information we collect, we can provide you with an easy to use and readily available forum to learn about and request information about our comprehensive restaurant data management products and services.

As we continue to develop our business, we may buy or sell businesses or assets. In such transactions, confidential customer information generally is one of the transferred business assets. In the event of a transaction involving the sale of some or all of Rosnet’s businesses, customer and site visitor information may be one of the transferred assets and may be disclosed in connection with negotiations relating to a proposed transaction. In such a case, the transferred information may become subject to a different privacy notice.

We do not collect financial related information via the website.

What security precautions are in place to protect against the loss, misuse, or alteration of your information?

Because information sent through the Internet travels from computer to computer throughout the world, when you give us information, that information may be sent electronically to servers outside of the country where you originally entered the information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Our site uses Transport Layer Security (TLS) which uses encryption to protect transfers of personal information. You will know that a webpage within our website uses TLS when you see the padlock symbol 🔒 or "https" in the URL. Information that you disclose by use of this site (as with any site that is non-secure), by posting a message or using e-mail, potentially could be collected and used by others. Do Not Track Codes

Do Not Track (DNT) is a privacy preference that users can set in their web browsers. DNT is a simple way for users to inform web services that have been integrated across the Internet (such as buttons, widgets, and other embedded features or content) that they do not want certain information about their webpage visits collected and shared across websites. The DNT browser setting is only supported by recent versions of major browsers. When you turn on DNT in your browser, we stop collecting the information that allows us to tailor suggestions based on your recent visits to websites that we interact with. Specifically, we stop collecting the unique browser cookie that links your browser to visits to these websites for tailoring suggestions or ads. Your Privacy Rights in California and other States

Right to Request Deletion. You have the right to request that your personal information be deleted. We may save personal information when permitted by applicable law including, without limitation, when the information is needed to complete a transaction, to detect or protect against security incidents or illegal activity, and for a legal or compliance purpose. If we delete your personal information, you will lose a personalized experience with our site and content might not be as relevant to you. Right to Opt-Out of the Sale of Your Personal Information or Sharing of Personal Information for Targeted Advertising. California residents and residents of certain other states have the right to opt-out of having your personal information sold or your personal information shared for Targeted Advertising. While we do not sell personal information in the traditional sense of selling personal information in exchange for money, certain activities of Rosnet (such as sharing online identifiers with third parties) may be considered a sale under California or other law. We do not sell personal information of consumers under the age of 16 if we have actual knowledge of the individual's age. Note that Targeted Advertising does not include advertising from or on behalf of Rosnet based on activities conducted on Rosnet's own websites or applications.

Right to Opt-Out of Profiling. Although we do not use the information collected from website visitors to profile website visitors in furtherance of decisions that produce legal or similarly significant effects, certain consumers have the right to opt-out of such profiling. Please see the Submit a Request section below to submit to opt-out of such profiling.  

Right to Obtain Copy of Your Personal Information. Certain consumers have the right to obtain a copy of the personal information in a portable and readily usable format. Please see the Submit a Request section below to submit a request for a copy of your personal information.

Right to Correct. You may submit a request to correct any inaccuracies in your personal information. To do so, please use the Submit a Request section below.

Right to Restriction. Although we do not collect this information from website visitors, residents of certain states have the right to submit a request to limit the use and disclosure of your sensitive personal information. Sensitive information includes information like your social security number, sexual orientation, religious beliefs, private health matters, union membership and other such information depending on the applicable privacy law. How to Submit a Request Regarding Your Privacy Rights? To submit a request to know the personal information we have about you or to submit a request to delete your personal information, please email us at the at the email address at the bottom of this Privacy Notice or call us at the toll free number below. When you submit a request to know or delete, you must provide your first name, last name, and email address.

Authorized Agents. Residents of certain states may designate an authorized agent to make a request on your behalf. To be able to act, authorized agents must submit proof that they are authorized to act on your behalf. We may deny requests from claimed authorized agents who do not submit adequate proof that they are authorized to act on your behalf. We do not process privacy requests sent to us using third party services that have not complied with our verification process. This is because such services often request that we click on hyperlinks which we will not do for data security reasons. These services are also susceptible to spoofing and other phishing attacks. One of our highest priorities is to treat your information safely and securely. If you live in a state that permits you to make a privacy request using a third-party agent, please have them contact us using the information above and we will take steps to identify them and ensure that they are your agent.

Verifying Requests. To help protect your privacy and maintain security, we will take steps to verify your identity before complying with your requests. For example, for requests to know and delete, we will attempt to match your identity to the information stored in our files. If we cannot, we will ask you to provide additional identifying information. We will use the information you provide in your request for the purpose of verifying your identity or authority to make the request.

Right to Non-Discrimination and No Retaliation. Residents of California, Colorado, Connecticut, Virginia, and certain other states have the right not to receive discriminatory treatment by us for opting out of sharing your personal information or exercising your privacy rights conferred by applicable privacy laws. Unless permitted by applicable privacy laws, we will not:

• Deny you goods or services
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties
• Provide you a different level or quality of goods or services
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

However, we may offer you certain financial incentives permitted by applicable privacy laws that can result in different prices, rates, or quality levels. Any legally permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Right to Appeal a Privacy Rights Request Decision. Residents of Virginia, Colorado, Connecticut, and certain other states have the right appeal our denial or limitation of your privacy rights request. Responses to Requests. Describe your request with sufficient detail that allows us to understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We will try to respond to your request within 45 days of when we receive it. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another without hindrance, specifically by electronic mail communication.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee; we will tell you why we made that decision and provide you with a cost estimate before completing your request.
